About the Service

Helium ("the Service") is a public AI gateway that provides unified access to large language models through an OpenAI-compatible API. The Service routes requests to third-party AI providers and returns generated content ("Generated Content") to the user.

All actions performed with the Service using your credentials are deemed to be actions performed by you personally. If your credentials become known to third parties, change them immediately and notify the operator of any suspected unauthorized access.

Generated Content

Content generated by the Service is created by artificial intelligence and may be inaccurate, incomplete or outdated. Any output of the Service is informational only: it does not constitute professional advice, a recommendation, guidance for decision- making, or the position of the operator.

Generated Content may lack originality and may coincide, fully or partially, with output generated for other users or with content of third parties. By using Generated Content you assume all associated risks, including risks related to infringement of third-party intellectual property rights.

When publishing or distributing Generated Content, you should clearly indicate that it was created with the help of AI, and you are responsible for ensuring it does not violate the rights of third parties or applicable law.

/07

Use in Your Own Products

If you use the Service to build your own online services or provide services to consumers, you must clearly inform them that the Service (AI technology) is used in the operation of your online services and automated systems and products, including chatbots, voice and virtual assistants, as well as about possible limitations and consequences related to such use.

When distributing works created with the Service, attribute the work to yourself, clearly indicate the role and contribution of AI in its creation, and make sure the work does not contain prohibited content.

/08

Data & Privacy

The Service collects minimal technical data required for its operation: request metadata, token counts, latency measurements, and anonymized identifiers. The contents of your prompts are processed by third-party AI providers according to their own policies.

You must not submit through the Service personal data of yourself or third parties, or data constituting state, banking, tax, commercial, medical or other legally protected secrets. Do not submit sensitive personal data, credentials or confidential information of any kind.

/09

License to Operate the Service

You grant the operator a simple (non-exclusive), royalty-free license to reproduce, store and process your prompts and Generated Content solely to the extent necessary to provide the Service: routing requests to AI providers, generating responses, recording usage statistics (token counts, latency, anonymized identifiers) and maintaining the operation and security of the Service.

This license does not give the operator the right to publish or distribute your content outside the scope of providing the Service.

/10

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE. USE OF THE SERVICE IS AT YOUR SOLE RISK.

YOU ASSUME FULL RESPONSIBILITY FOR ALL ACTIONS PERFORMED WITH THE SERVICE AND FOR ANY CONSEQUENCES RESULTING FROM SUCH ACTIONS.

WHERE LIABILITY CANNOT BE EXCLUDED, THE TOTAL AGGREGATE LIABILITY OF THE OPERATOR SHALL NOT EXCEED THE AMOUNT OF FEES ACTUALLY PAID BY YOU FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY (WHICH MAY BE ZERO IF THE SERVICE IS PROVIDED FREE OF CHARGE).
